The constitutional conflict over the political legacy and electoral identity of the All India Trinamool Congress (AITC) has reached the Supreme Court of India. Party founder and former West Bengal Chief Minister Mamata Banerjee has filed a special leave petition challenging the Election Commission of India (ECI)'s interim order freezing the party's official registered name and its iconic 'Flowers and Grass' (Jora Ghash Phul) symbol. The poll panel's directive—triggered by an intra-party rift led by West Bengal Legislative Assembly Leader of the Opposition Ritabrata Banerjee and senior MLA Arup Roy—compelled both camps to enter the upcoming October 6 Assembly by-elections in Nandigram and Rejinagar under provisional identities. The ECI designated the founder-led camp as 'Mamata All India Trinamool Congress' with the 'Football Player' symbol, while recognizing the breakaway group as 'Democratic Trinamool Congress' under the 'Envelope' symbol.

The Supreme Court Plea, Constitutional Grounds, and Tenth Schedule Conflict

In her petition citing the Election Commission and Ritabrata Banerjee as principal respondents, Mamata Banerjee argued that the poll authority committed a serious jurisdictional error by imposing a premature interim freeze under Paragraph 15 of the Election Symbols (Reservation and Allotment) Order, 1968 without substantively adjudicating the party's registered organizational constitution. The petition contends that the commission fundamentally erred by according legal weight to submissions made by rebel legislators who are currently subject to active disqualification petitions under the Tenth Schedule (Anti-Defection Law) of the Constitution of India before the West Bengal Legislative Assembly Speaker.

The dispute reflects an intense organizational split. The rebel faction claims the allegiance of approximately 60 out of 80 MLAs in the state assembly along with 20 of the party's 28 Lok Sabha MPs, maintaining that a special session convened on June 22 legally elected Arup Roy as party chairperson after the term of the National Working Committee lapsed. Conversely, Mamata Banerjee's loyalists argue that the updated party constitution submitted to the ECI in March 2026 establishes a five-year mandate for office-bearers elected in 2022, legally preserving her tenure as supreme chairperson through 2027.

"Freezing a recognized party's 28-year-old electoral symbol at the behest of defecting legislators facing disqualification violates settled jurisprudence and fair electoral competition," the petition outlined.

The Statutory Precedents: Paragraph 15 & The Symbols Order

Under Paragraph 15 of the Election Symbols Order, 1968, the Election Commission possesses exclusive quasi-judicial authority to determine rival claims within recognized state and national political parties. The poll panel applies the 'test of majority' across both the legislative wing (elected MPs and MLAs) and the organizational wing (National Executive members, delegates, and party committees).

In justifying its interim ruling, the Commission stated that conclusive evidentiary examination of thousands of affidavits and organizational registries could not be resolved prior to the October 6 bypolls. Adopting the procedural template deployed during earlier splits in the Shiv Sena (Eknath Shinde vs. Uddhav Thackeray) and the Nationalist Congress Party (Ajit Pawar vs. Sharad Pawar), the ECI barred both factions from utilizing the original nomenclature and symbol to place the rival groups on equal footing and eliminate voter ambiguity on electronic voting machines.

The temporary loss of the 'Jora Ghash Phul' marker creates significant tactical challenges on the ground in Nandigram, the agrarian stronghold that was central to Mamata Banerjee's historic political trajectory. The administrative freeze has also mobilized national opposition figures. Leaders from the INDIA bloc, including Congress leader Rahul Gandhi and AAP national convenor Arvind Kejriwal, extended political support to Banerjee, characterizing the interim order as administrative pressure targeting regional parties.
